Montclair State University (“MSU”) and the Montclair State University Foundation (“Foundation”) (collectively “we”) license this portion of its web site and online presence to Blackbaud, Inc.  We have created this privacy statement in order to demonstrate our firm commitment to privacy and to describe the information-gathering and dissemination practices by our web site.

Subject to our compliance with all applicable federal and/or state laws, including without limitation, the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), the Family Educational Rights and Privacy Act of 1974 (“FERPA”) and the Gramm-Leach-Bliley Financial Services Modernization Act (“GLB”), we reserve the right to use or disclose any information without notice or consent as needed to satisfy any law, regulation or legal request; to conduct investigations of consumer complaints or possible breaches of law; to protect the integrity of our site and our property; to protect the safety of our visitors or others; to fulfill your requests; or to cooperate in any legal investigation.

1.  Cookies
Cookies are small text files stored by your browser in your computer when you visit our web site. Our web site uses cookies to recognize users and avoid repetitive requests for the same information. Personal Information
"Personal Information" is information that would allow someone to identify or contact Users, including, for example, your names, organizations, addresses, and email addresses. Personal Information does not include aggregated information or nonpersonally identifiable information.

Nonpersonally Identifiable Information
"Nonpersonally Identifiable Information" is anonymous information about you that does not include your names or contact information. Examples of such aggregated data would be IP addresses, browser types, and access times. This information may be used to customize the Foundation's website for Users and may not include or refer to Personal Information, such as Users' email addresses, when using this type of data.

Aggregated Information
"Aggregated Information" refers to information gathered by aggregating Nonpersonally Identifiable Information to provide summaries of use of the website. This Aggregated Information shows usage patterns used to do such things as negotiate with vendors of Internet services. Such Information is not linked to your Personal Information. 

2.  Credit Card Transactions
Some features of our web site enable credit card transactions, and the submission of personal information is completely voluntary. Those features may include the purchasing of tickets through event registration or donations through our web site.  We use Blackboard Merchant Services, Inc. (“BMSI”) to process on-line credit card transactions on our web site and assure us that measures have been taken to make the transactions secure for you.  

Our web site utilizes industry standard Secure Sockets Layer (SSL) servers to encrypt your information and prevent unauthorized access. In addition, our web site participates in the Better Business Bureau Online Reliability Seal Program to further ensure the security of your transactions. Shortly after a purchase or refund is processed, you will receive a confirmation via e-mail. You are advised to print out and save a copy of the order confirmation for verification necessary to request refunds or resolve any disputes.

You are not responsible for unauthorized transactions posted to your credit card that occur as a result of submitting a credit card number to this site. Our web site uses industry standard Secure Sockets Layer (SSL) servers on our transaction pages. It encrypts all of your personal information including name, address, and credit card number to prevent unauthorized access as the information travels over the Internet.

Under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50.00 of fraudulent charges. If your bank does hold you liable for any of this $50.00, we will assist you in causing BMSI to cover it up to $50.00 if the unauthorized use of your credit card resulted through no fault of your own from transactions made at this web site while using our the secure server.

3.  Visitors from Outside the United States
Montclair State University, the Montclair State University Foundation and the server which makes this web site available worldwide is located in the United States. All matters relating to this site are governed by the laws of the State of New Jersey in the United States. Any information you provide will be transferred to the United States. By visiting this web site and submitting information you authorize this transfer.
